WV Supreme Court Rejects Appeal
The WV Supreme Court has rejected an attempt to halt construction of the AP TrAIL.  The appeal, which was filed by the Sierra Club and Thomas Hildebrand, a Virginia resident, was denied by a 4-1 decision.  No comment was given by the Justices in rendering their decision. 

PA and VA Appeals Continue
Appeals of the decisions to approve part of the AP TrAIL in Pennsylvania and all of the line in Virginia continues in both states.  The Pennsylvania appeal, filed by the Energy Conservation Council, has gained some support from the Piedmont Environmental Council, the Sierra Club and the Union of Concerned Scientists.  You can read the ECC's Brief by clicking here and the Amicus Brief filed by PEC and others by clicking here.

Federal Push for Transmission Continues
There are a growing number of federal bills focused entirely, or in part, on expieditied transmiiion line planning and siting.  Some have a "green" energy focus, while others don't even pretend.  There are currently bills from Senators Reid, Binaman, Dorgan and Nelson, as well as from Congressmen Markey, Waxman and Inslee.
Groups such as PEC and others are working with Senate and House staff members on the environmental dangers of these bills along with the needless increased incentive for transmission companies to site new lines.  We appreciate the update on the Transmission legislation from the Piedmont Environmental Council.  They have been and continue to be a participant in the battle to stop the expansion of needless, polluting and damaging transmission lines when other, less destructive and highly effective options exist.

ECC Files Appeal
The Energy Conservation Council filed an appeal of the Pennsylvania Public Utility Commission decision pertaining to the 1.2 mile section of the AP TrAIL known as the 502 Junction Segment.  The appeal points out numerous errors made by the Commission in arriving at the decision to approve the Segment.  You can read the entire appeal by clicking here.   This was an obvious reaction to the unbelievable ruling offered by the PUC in December that completely ignored an entire years worth of evidence from public input hearings, technical evidentiary hearings and briefs.  The appeal asks the courts to reverse the decision and direct the PUC to enter a decision dening the TrAIL Co applications. 

Washington County Collaborative
As a result of the December ruling by the PUC, the Washington County Collaborative has begun.  It is still in the early stages as details are worked out on how the Collaborative will function.   Little information will be available to the public to encourage the process to function properly and maintain the integrity of the process.

PUC Decision - What Were They Thinking?!?
The PUC gave a partial ruling at its public meeting last week.  Amazingly, they completely ignored an entire years worth of evidence in the form of public input hearings, technical evidentiary hearings and briefs.  Not to mention a detailed 364-page Recommended Decision by their own Administrative Law Judges that unequivocally suggested a complete denial of all TrAIL Co applications.  But instead of listening to the two men who spent more than a year collecting and weighing the facts in the case, they issued a 4-1 ruling in favor of the 502 Junction and 1.2 mile line to the south.  They also issued a ‘Stay” for the Prexie facilities and are encouraging the “Collaborative” process to go forward that as suggested by Allegheny Power. One can only wonder how the four Commissioners arrived at that decision!  There must be more to it than we know, for their decision defies logic.  Certainly it would seem some kind of politics or other dealings have been going on behind closed doors for this ruling to occur. 
 Four of the five Commissioners ruled in favor of TrAIL Co, with only Commissioner Christy voting to deny the applications by TrAIL Co.  Commissioner Christy was the only Commissioner that took the time to actually attend the hearings and listen to the facts in the case.  He stated “As a PUC Commissioner, balancing the interests of the public with that of our utilities is my primary responsibility.  It is clear that customers in western Pennsylvania will receive little in return for the siting of these lines in their back yards except upward pressure on the price they will pay for generation and transmission.  Only the stockholders, generation owners and perhaps customers in eastern PJM will benefit. I can not support a project that imposes all of the costs and none of the benefits on one segment of the public. I would like to make it clear that my comments should not suggest that I am opposed to the construction of new, large, high-voltage electric transmission projects in the Commonwealth. Transmission line siting cases present two fundamental issues to this Commission - whether the need for the line exists; and, whether the proposed route is the best of all alternatives considered.  It is painfully apparent from the record that TrAILCo did not come close to meeting its burden of proof in this case on either count.”

What Now?

Although no formal announcement has been made by any of the active participants in the hearings, an appeal of the ruling would seem logical and necessary.  With so much evidence to the contrary of the PUC ruling, an appeal to the State Superior or Supreme Court should occur.  However, this is a costly undertaking for the Energy Conservation Council.  Should the Board decide to move in that direction, funds will need to be raised to continue the fight.  We would hope that the Office of Consumer Advocate and/or Office of Trial Staff would also appeal the ruling. 

 

In the meantime, you certainly have the power to make a difference!  Surely you too have to be amazed at this ruling and have some thoughts that you would like to share with someone.  So, start writing those letters!  Send them to all the elected officials, including Governor Rendell himself.  Include all the local newspapers and other media outlets that you have sent to in the past.  Ask the questions and make the case that there is no logical reason for these four men to reach a completely opposite ruling to the Recommended Decision of the two Administrative Law Judges and Commissioner Christy. 

 

The other thing to do is be an active participant in the process.  Although we don’t agree with this decision, we knew it would not end the process, regardless of which way the ruling went.  The Collaborative process in Washington County is supposed to be open to anyone that wishes to participate.  So get to the meetings and be a part of the process.  Give your input and help determine an appropriate decision, which could be to do nothing more than was recommended by the opposition during the PUC hearings. 

 

The worst thing you can do now is nothing!  Write the letters, stay involved and get ready to respond should the call come from the ECC to raise the funds needed to appeal the decision.  It’s not over yet!!!



PUC RULING NEAR?

Virginia Approves TrAIL, PENDING PA PUC APPROVAL!!!

The Virginia Public Service Commission has granted Dominion and TrAIL Co’s application to build the AP TrAIL.  However, it was approved contingent upon both West Virginia and Pennsylvania approving the line.  The PSC decision was not a huge surprise, but it certainly is a disappointment.  Many groups, elected officials and organizations in the Virginia area fought against the project, led by the Piedmont Environmental Council.  The decision is apparently going to be appealed to the Virginia Supreme Court.  But nothing will be built if the Pennsylvania PUC adopts the 364 pg Recommended Decision issued by Administrative Law Judges Nemec and Hoyer!

 

PUC Misses NIETC Deadline

On October 5, 2007, the Department of Energy issued a National Interest Electrical Transmission Corridor designation that included most of the mid-Atlantic area.  This designation started a one-year time limit for decisions related to high-voltage transmission lines.  Any project that was not granted a final decision within one year of filing an application could try using a “back-door” clause in the law that allows the utility to ask for federal approval of the project.  Despite missing the deadline, we believe any appeal to FERC will be denied.

The PUC will issue a final ruling in the near future and we feel confident that they will deny the AP TrAIL!   The ALJ’s Recommended Decision was extremely well written, driven by the facts of the case, and provide a sound basis for denying all five applications.  We believe that can and will happen, but TrAIL Co continues to work hard on swaying elected officials to give their approval of the 502 Junction and 1.2 mile line to the south. 

 

DeWeese Remains Opposed!

House Majority Leader Bill DeWeese continues to stick with us in opposing the AP TrAIL.  TrAIL Co has been working overtime to gain support of their last ditch effort to save the 502 Junction and 1.2 mile line traveling south to the West Virginia line.  TrAIL Co saw the writing on the Recommended Decision and realized that they were in danger of having all five applications denied.  So they have strategically worked to try and “barter” support from the opposition by giving up their plans for the line from the 502 Junction north to Prexy and offering to address the alleged concerns in Prexy with a collaborative.  In return, they asked for support of the “money-maker” that would link existing and new generation upwind of Pennsylvania.  But Bill DeWeese said no, and continues to oppose the line.  He realizes that this is the beginning of terrible energy policy and all the ill affects from constructing that line on Pennsylvanians.  Those affects include higher rates of nearly $50 million dollars per year and increased pollution from additional generation plants.  TrAIL Co testified in West Virginia that four new coal-fired plants could be sited if this line were constructed.

The Fight Continues
Although much has happened over the last several days, Stop the Towers and the Energy Conservation Council continues to oppose the AP TrAIL.  In fact, most of the recent developments solidify the stance that the TrAIL is a profit-driven project that does not reflect any reliability issues in our region, but instead is about moving cheap, coal-fired generation to the east! 

Reply's to TrAIL Co Exceptions Filed
The Energy Conservation Council as well as several other interveners and elected officials have filed Replys to TrAIL Co Exceptions.  The purpose of the Reply is to counter any arguments offered by TrAIL Co as to why the Administrative Law Judges Recommended Decision was incorrect.  As you recall, the ALJ's recommended a complete denial of the entire application by TrAIL Co!  We thank each of the groups that filed Replys, including House Majority Leader H. William DeWeese, the Office of Consumer Advocate, the Office of Trial Staff and the Washington County Commissioners.  You can read each of these Replys by clicking on the respective icons below.

TrAIL Co Agreement with Greene County
TrAIL Co has committed to an agreement with the Greene County Commissioners on the TrAIL.  In the agreement, TrAIL Co has agreed to give back the rights-of-ways to landowners in Greene and Washington County in return for support to construct the 502 Junction Substation and 1.2 mile line going south to the WV line.  The agreement is not final, but is expected to be signed on Friday.  The Agreement contains similar language to the Motion for Partial Stay that TrAIL Co submitted to the PUC.  They request that a "collaborative" be formed to address the supposed "reliability" issues in Washington County.  You can read the Agreement by clicking here.

Exceptions and Motion to Stay filed by TrAIL Co
On Wednesday, September 10th, TrAIL Co filed its "exceptions" to the Recommended Decision offered by the Administrative Law Judges.  In the exceptions, TrAIL Co claimed it was "ignored" and stuck to their story of "reliability issues" as driving the "need" for the project.  But, they also made it clear they are willing to deal.  TrAIL Co filed a Motion for Partial Stay asking the PUC to delay a ruling on the Prexy Facilities for 90 days.  They now would like to get a collaborative group together to look at creative methods or alternatives to the Prexy facilities.  Suddenly, they are willing to consider the less destructive, less costly and more appropriate alternatives offered by the Office of Consumer Advocate.  However, in return, they want the 502 Junction and the 1.2 mile line going south to West Virginia to be approved immediately.  Obviously, this is the most important part of the request because it links the cheap, coal-fired generation plants in our region to the east where they claim their is growing demand that must be met. 

Our Take on the Offer?
NO WAY!  This would give TrAIL Co the first piece of the puzzle, and they would come back later to finish the job!   Many people, from Mt. Morris, PA to Virginia, would needlessly suffer as a result of a line that is about economics, not reliability.  Among the many needless negative affects would be increases in rates for consumers in Southwestern Pennsylvania, increased pollution/emissions of green house gases, scarring of the landscape, and the list goes on.  But just as important, it would be the beginning of a national trend or "policy" to meet future demand by building high-voltage transmission lines rather than look to localized generation, conservation and demand-side managment systems.  We can't let that happen!

What to do?
Start by contacting your elected officials!  We need them to stay the course and to monitor for any  "deal" or inappropriate influence upon the PUC proceedings.  Thank them for their support, but also remind them that we must have them to win!  They may be approached by TrAIL Co, asking for support of their new strategy.  Anything can happen at this point, so let's keep them on our side.  To help you with this, we've constructed a letter that you can send to them, or use to create your own letter.  Addresses of the elected officials are included on the second page of the letter.  But don't delay!  Call, email or send your letter to the officials as soon as possible. 
A second, and just as important task, is to file a "Reply to TrAIL Co Exceptions" with the PUC.  You can write a letter that responds to the exceptions, or that simply states your support for the Recommended Decision offered by the ALJ's.  However, there are some guidelines that must be followed.  Your letter must include a heading of "Reply to TrAIL Co Exceptions" and be addressed to James J. McNulty, Secretary  of the PUC.  The letter must be filed with the entire full-service list as well.  To help you with this task, you can simply mail your original letter (with signature) and nine copies to Susan Foster Blank by 10:00 am on Friday, September 19th.  Susan has agreed to make certain the letters are sent to the appropriate people.  You can obtain Susan's mailing address by emailing her at sfblank@bentcom.net.

What Happens Now?

When the Administrative Law Judges released their "Recommendation" to the Public Utility Commission, the timeline to reply with "Exceptions" began and the deadline is now drawing near.  Allegheny Power, a.k.a. TrAIL Co, is expected to file by Wednesday, September 10th their exceptions to the rulings.  It would seem as though they would have many, since the ruling was a complete denial of their case.  The facts revealed in the Judges Recommendation made it clear that this project was about profit, and not "need" or "reliability."  It pointed out the many failures by TrAIL Co to fulfill their "burden of proof."  But if you think this is over, think again!  Anything can happen and Allegheny Power has made it clear that they are going to continue the fight. 

We are speculating that TrAIL Co will focus its efforts on the 502 Junction.  That is the key to shipping the cheap, coal-fired generation to the East.  They will need to somehow "offset" the blistering given in the Recommendation by the ALJs, especially the comment that "granting approval....at this juncture rewards a lack of foresight and proper maintenance, and has policy implications for the location of future generation...."  But one only needs to look at what happened in WV and VA.  This company is determined and will do whatever is necessary to get this approval.  That is why WE MUST REMAIN Vigilant!  Should Allegheny Power find a way to be granted the application to build just the 502 Junction, they win!  In a year or two or ten, they will be back.  Only then they will be smarter.  They will have learned from all their mistakes in this case and will make sure that they create a stronger case to build the 502 to Prexy line. 

So what can you do in the meantime?  Start by talking with your local elected officials.  They remain an important line of defense for protecting the integrity of the PUC process.  Ask them if Allegheny Power has contacted them?  Remind them that we oppose this entire project and that there is absolutely NO BENEFIT to Pennsylvania should any part of this line be built.
It is also important that we continue to monitor all areas of the proposed route and continue to communicate with our friends and neighbors, especially those near the 502 Junction.  There needs to be more publicity as well.  Write a letter to the editor, continue to post signs and talk within your communities. 

Although it may seem unfair, we actually have the weight of all the residents in WV and VA riding on our efforts as well.  Both states appear to be willing to grant approval for construction, but only if all other states approve the project!  So far, PA appears to be the only state that is looking at the facts and standing up for its residents.  Let's keep it going!

ALJ’s Recommendation – DENY the AP TrAIL!!!

The Administrative Law Judges for the Pennsylvania Public Utility Commission have issued a “recommendation” to the Commission to deny all five applications of TrAIL Co.  In the 364 page report, it states “We recommend the denial of all five pending Applications based on our conclusion that TrAIL Co has failed to carry its burden of proof with regard to all.”   In the Conclusions and Recommendations section of the report, the ALJ’s blast TrAIL Co for all the same reasons that Stop the Towers, the Energy Conservation Council, the Office of Consumer Advocate and others have been stating from the beginning.  The ALJ’s agree that this project is about transporting cheaply generated power here is western PJM to the east, that no less-intrusive options were even considered and that the alleged need is “minor or even non-existent.”

Although this is the recommendation of the ALJ’s, the Commission must still issue the final ruling.  We would hope that they follow the well-detailed recommendation, but only time will tell.  However, this certainly validates all the concerns and issues raised by many residents, businesses, civic/environmental groups and all our elected officials.  In fact, the ALJ’s point to the “universal opposition of elected officials” in the conclusions as proof that TrAIL Co did not effectively communicate with residents in this process.  We want to thank all of our elected officials for their hard work and dedication in this effort and we certainly encourage them to continue the fight.  Each of them deserves recognition for standing up for their constituents and making their feelings known.  Be sure to thank:

Also, significant credit must be given to the Office of Consumer Advocate.  The Consumer Advocate and his staff spent many, many hours working on this case and represented the residents and ratepayers of Pennsylvania well! 

This process is still a long way from being over as the Commissioners must give a final ruling and then we still have the NIETC designation to contend with.  But, it certainly is satisfying to get confirmation that we were right all along!!!

Virginia and West Virginia Rulings
The WV Public Service Commission has approved TrAIL Co's application to construct the AP TrAIL.  It is a disappointment, but not really a surprise.  The WV Consumer Advocate did NOT look at the need for the line, but rather looked to mitigate the impacts of the line.  According to news sources, the state came to a "deal" with TrAIL Co to bring about 150 jobs to WV (some moved from PA) and to give affected landowners a partial seven year reprieve on their electric bills.  The Governor himself made it clear early on that he thought this project would be good for WV and was able to get contributions to the Governor's Office of Economic Opportunity for expansion of the current energy efficiency program from TrAIL Co.  You can an article about the WV approval of TrAIL by clicking HERE.  
Hope is not completely lost in WV though, as the Sierra Club has vowed to continue the fight by appealing to the state Supreme Court.  Also, as was the case in Virginia, the granting of application is dependent upon both Virginia and Pennsylvania approving the line.  To read the final order, go to WV PSC Website.
 

In Virginia, the State Corporation Commission released a "recommended" decision from the hearing examiner that also supported the TrAIL project.   Once again, it is conditioned upon both WV and PA approving the line.  There were some deals made along the way there as well and a least one major opposition group, CPV Warren, dropped out of the proceedings after the company was purchased by Dominion.  As will happen here in Pennsylvania, this is the hearing examiners recommendation to the Commission.  The Commission will give a final ruling in the near future, so there is still hope.  Piedmont Environmental Council and other groups have also vowed to continue the fight!  If you would like to read the hearing examiners decision, go to the Piedmont Environmental Council website. 


Any "Deals" Here in PA?
 

Although it appears that there are no "deals" being made here in Pennsylvania as occurred in WV and VA, you just never know!  That is why it is so important that we continue to talk with our elected officials and encourage them to stay vigilant!  Let them know that we are, and always will be, opposed to this project!  Remind them that the Office of Consumer Advocate, the West Penn Power Interveners, and even the Office of Trial Staff, which is a branch of the PUC itself, are all opposed to this project based upon the facts and evidence presented!  Be sure to thank them for all they have done in the past, but also encourage them as there is still much to do in the future!  This battle is still a ways from being over, and we need them to stay with us all the way to the end.  We also need them to keep a watchful eye on any "deals" that TrAIL Co might try to make!  You can follow this LINK for a list of the elected officials for Washington and Greene Counties.


STILL TRESPASSING!

Although TrAIL Co agreed to abide by a "Code of Conduct" for all of its employees and subcontractors, they're at it again!  Only now, it's at night.  Subcontractors, attempting to complete the environmental surveys, looking specifically for the endangered Indiana Bat, are setting up nets after dark and removing them before daylight.  On at least two occasions, residents have found these employees on their property without permission.  In the "Code of Conduct" contained in TrAIL Co's Answer to the OCA Request for Injunctive Relief, filed on November 7, 2007, TrAIL Co agreed to:

 

 "Obtain unequivocal permission to enter property for purposes of surveying or conducting environmental assessment or other activities.  Clearly explain to the property owner the scope of work to be conducted based on the permission given.  Attempt to notify the occupant of the property each time you enter the property based on this permission."

 

Apparently they forgot to tell the environmental surveyors!  Thus, it is very important that we (you) contact the police and file a complaint anytime you find TrAIL Co representatives trespassing on your property.  Also, please help police your neighborhood.  Call your neighbors when you see cars/trucks sitting along the road near their properties.  Because the PUC record is closed, we can not take these issues to the PUC.  But we can file police reports and then tell our stories with Letters to the Editor.  If we can bring attention to this inappropriate behavior, we can stop it, or at least delay it! 


Senate Testimony Overview
The Senate Energy and Natural Resources committee heard testimony last week regarding the misapplication of Section 1221 of the Energy Policy Act 2005.  Specifically, testimony was given relating to the designation of the NIETC areas and the possible impact this could have in the future.  The Pennsylvania Land Trust has been very active in bringing attention to the problems associated with the NIETC designations and continues to work for positive changes to the law.  You can read the excerps by clicking HERE.  We thank the PLT for all their efforts and for providing us with the overview.

Senator Casey and ECCO Expert George Loehr to Testify before Senate Committee
On Thursday, July 31st, Senator Robert Casey will testify before the Senate Energy and Natural Resources committee about his concerns with the National Interest Electric Transmission Corridor (NIETC) designation and it's implication to Pennyslvania.  Senator Casey came to Greene County several months ago to see and hear the impacts that could take place should this designation remain in place.  On his website, Senator Casey collected over 4,500 signatures from people concerned about the NIETC designations.  He along with thirteen other Senators requested these hearings and finally, they will happen.  You can read Senator Caseys written testimony by clicking here.  Please thank the Senator and his staff for their diligence in these hearings.  These hearings may not be aired live on CSPAN, but can be viewed on the committee website at http://energy.senate.gov/public/

Also testifying will be Energy Conservation Council expert, George Loehr.  You can read his written testimony by clicking here.  George testified on behalf of ECCO before the PUC earlier this year and his testimony from the PUC proceedings can be found on our PUC Testimony webpage.  Many conservation groups have submitted their own statements as well.  Unfortunately though, the panel of witnesses to testify before the committee are likely to support the NIETC designations.  We can only hope that the Senators will listen to both sides and look at the big picture.  If they do, they will realize that EPAct '05 must be revised! 

Bad News in Virginia
The hearing examiner for the Virginia Service Corporation Commission has recommended the SCC approve the Virginia portion of the AP TrAIL, contingent upon approval of the West Virginia and Pennsylvania portions of the line.  The Piedmont Environmental Council and others put on an excellent case showing the alleged reliability issues could be resolved by spending $2 to $50 million, but the hearing examiner chose to recommend spending nearly $1 BILLION!  This is not the final decision of by the SCC and Piedmont and others have vowed to continue their fight against this greed-driven project!  You can read the entire 223-page examiners report as well as PEC's final briefs by visiting the Piedmont website.

"Recommended" Decision Delayed!
It was learned last week that the Administrative Law Judges will not issue their "recommended" decision in the AP TrAIL application until the end of summer.  We do not know what caused the delay.  However, the PUC has a number of new transmission related projects being filed across the state.  The PUC is also involved in litigation against the Department of Energy's NIETC designation, so it could be the delay has nothing to do with the actual case.  We certainly believe that this is a slam-dunk decision, with everyone involved opposing the project, except for TrAIL Co of course!  Hopefully the decision will rendered soon, with a denial of the application!!

Some Good News
The Senate Energy and Natural Resources committee will hold hearings on the 2005 Energy Policy Act, which is responsible for the Mid-Atlantic NIETC designation.  Our own Senator Robert Casey has worked for quite some time asking the committee to hold these hearings, and we certainly thank him for his efforts.  As you probably know, the NIETC designation is the "back-door" that TrAIL Co will most likely use if (when) the PUC denies their application to build the transmission line.  Unfortunately, the hearings will occur this week on Thursday, July 31st at 9:30 am.  The hearing will be in 304 Dirksen Senate Building, Washington D.C.  The purpose listed on the Senate Hearing Schedule webpage is "to conduct oversight on the state of the nation?s transmission grid, as well as the implementation of the 2005 Energy Policy Act transmission provisions, including reliability, siting and infrastructure investment."

Waiting on a (Recommended) Decision

It is expected later this month or in early August that the Administrative Law Judges will render a “recommended” decision on the Allegheny Power application to build the AP TrAIL.  Although this decision is not the final decision by the PUC, it will give us an idea of how the Judges interpreted all the information and testimony presented over the last twelve months.  We certainly feel that we have proven the AP TrAIL is an unnecessary, greed-driven project that will NOT benefit anyone in our region.  Soon we will see if the ALJ’s feel the same way.  As soon as their decision is announced, we will post it here!

TrAIL Co is Not Waiting for Decision

Although TrAIL Co has admitted to not owning the rights-of-ways, that they are not a public utility and that the project has not been approved by the PUC, they continue to work on various tasks related to the project.  They are currently attempting to get access to properties to conduct bat surveys (for the endangered species, Indiana Bat) as well as historical and environmental surveys.  They have subcontracted a company whose trucks say GAI Consulting, so watch out for them as well.  Please remember that you do NOT have to permit them onto your property and that TrAIL Co has agreed to a “code of conduct” that will respect property owner’s wishes.  Tell them to stay off your land and be sure to report any violations to the Energy Conservation Council Hotline at 724-267-3040. 

 

Right-of-Way Lawsuits Move Forward

TrAILCo attorneys' attempt to intimidate the Washington and Greene County plaintiffs failed miserably!  Although they thought they could overwhelm the residents with their discovery demands and deadlines, attorneys Dave Fasulo and Judge Richard DiSalle were able to timely deliver not one but TWO BIG BOXES of answers to interrogatories and lots and lots of documents to their attorneys in the Washington County case.   In Greene County, the same attempt is being made, but once again residents are stepping up and completing the requests in a timely manner.  Thanks to all those who worked hard and under the pressure once again!!!!!! 

 

Energy Legislation Update

In the budget battle, one of the two bills concerning energy was passed by the General Assembly.  SS HB 1, known as the Clean Energy Funding bill, was approved as part of the negotiations to approve a budget.  This bill allocates $650 million for funding clean energy projects in Pennsylvania, including $100 million to help homeowners and small businesses purchase and install solar photovoltaic systems.  Another $80 million will be available through grants and loans for solar energy development projects.  The reminder of the funding goes to deployment and manufacturing of other clean energy technologies, energy efficient heating and cooling systems, and support of early stage activities and research in clean energy.

Unfortunately, the Senate chose not to take action on HB 2200 known as the Energy Savings bill.  This bill would help Pennsylvanians deal with the upcoming expiration of rate caps and potential increases of 50% in their electric bills.  HB 2200 would mandate that electric companies supply consumers with Smart Meters that help to conserve energy and reduce demand during peak periods by supplying real-time data to the users.  There must be a push by all residents to get the Senate to take up this important legislation in September.  Please continue to call and talk with your Senator about HB 2200.

 PUC Closes Record on TrAIL Application

On May 30th, the Public Utility Commission formally closed the record on the AP TrAIL process.  Intervenors filed their final comments, so now we wait and see what the recommended decision by the Administrative Law Judges will be.  This should occur late this summer with a final decision from the Commission sometime in early fall.  Although there are still “things to do” on other fronts, this part of the battle is through for now. 

We are extremely proud of Wil Burns, who represented the Energy Conservation Council!  Wil has given so much effort and time away from his family to protect each of us in SW PA from this unneeded, unwanted, greed-driven project, and no one could have done it better!  Thank you, Wil.  We are all indebted to you!  We also want to thank the Office of Consumer Advocate, the Office of Trial Staff and the West Penn Power Interveners for their open, fair assessment of the TrAIL project.  They too put in many hours and came to the same conclusions.  The Briefs as they are known, are summaries by each party stating their findings and conclusions about the proposed TrAIL.  The documents are lengthy and in great detail.  You can download and read these documents in their entirety by going to our PUC Testimony webpage.  Here is a quick look at the conclusions of these groups.

 

According to the Energy Conservation Council….

“The project provides no tangible benefit to Washington and Greene counties.”

 

“The Applicant, Trans-Allegheny Interstate Line Company, has “persistently flouted and defied the Public Utility laws” and is unfit to be a public utility, and therefore they should be denied a certificate of public convenience.”

 

According to the West Penn Power Interveners….

“Allegheny Energy stands to reap significant financial gains from the approval of TrAIL at the expense of the West Penn ratepayers.”

 

“The evidence confirms that the 502 to Loudon portion of TrAIL is an economic based, profit driven project, and any benefits of TrAIL that might inure to the benefit of customers in the West Penn service territory are outweighed by the costs they would be forced to bear.  TrAILCo has failed to bear its burden of proof under Pennsylvania law.”

  

According to the Office of Trial Staff (a department of the Public Utility Commission itself)….

 …”it is the obligation of TrAILCo to affirmatively prove by a preponderance of the evidence that it has met the applicable Commission rules and regulations regarding the siting of high voltage transmission lines… A thorough review of the record will aptly demonstrate that TrAILCo has simply failed to do so with regard to several areas of inquiry and, as such, its Application should be rejected based on its failure to sustain its burden of proof.”

 
“Based upon our thorough scrutiny of all aspects of the instant Application and our responsibility to represent the public interest, OTS recommends that the Commission deny the Application for TrAILCo's failure to meet all provision of the rules and regulations governing the siting of high voltage transmission lines here in the Commonwealth.”
   

According to the Office of Consumer Advocate….

“This Commission must reject the Company’s invasive, more environmentally detrimental and inefficient 500 kV approach to providing reliable electric service to the people of southwestern Pennsylvania."

“Applicant Trans-Allegheny Interstate Line Company has failed to meet its burden of proving that its proposed Prexy Facilities are necessary and proper for the accommodation, convenience and safety of the public, pursuant to the Public Utility Code.”

Unfortunately, the close of the PUC record does not end this battle.  There are still several fronts that we need to continue to work.  Remember, the NIETC designation is still a threat regardless of how the PUC rules later this fall.  Senator Casey and many others are still fighting these designations and will need our continued support.  Be sure to go to his website http://www.casey.senate.gov/actions/ and sign the petition opposing the NIETC.  We are hopeful that there will be Senate Hearings later this summer on this issue.  More to come later on the NIETC battle.

Here in Pennsylvania, we also have legislation that is “stuck” in the State Senate that could alleviate future demand issues, which is what Allegheny Power claims is the reason for the TrAIL.  The Senate has two bills that need to be approved and sent the Governor for his signature.  You will find additional information on both bills (HB 2200 and SS HB 1) below.  Continue to call your Senators and write your letters to anyone that could help get these bills approved.

Suit Filed in Greene County
Attorney Richard DiSalle filed a Multi-Plaintiff Lawsuit on behalf of Greene County residents on May 1, 2008.  The suit questions the legality of rights-of-way being referenced by the proposed Allegheny Power/TrAIL project.  The lawsuit addresses concerns about the scope, location and validity of these rights-of-way.  It raises the issue of the rights-of-way being decades old and contends that they were abandoned by Allegheny Power years ago.  This is the second lawsuit that Judge DiSalle has filed regarding the Allegheny Power/TrAIL project.  A similar lawsuit was filed in October of last year on behalf of Washington County residents, and it is proceeding through litigation in the Washington County courts.  If any resident of Washington or Greene County is interested in joining the suit, please contact Susan Blank at (724) 228-5030.

Community Outreach/Education Continues
The effort to protect Western Pennsylvania landowners, rate payers and the environment from the ill-conceived AP TrAIL continues!  A plane pulling a Stop the Towers banner flew over the city of Pittsburgh on Saturday just before the start of the Pirate baseball game.  It is our hope that we can educate and involve as many citizens in our region as possible in this effort.  If you are a new visitor to this website, please read the background information on our fight.  If you agree with us, you can get involved by taking action as suggested below.
We also hope to get on TV next weekend.  The WPXI-TV show Our Regions Business Report has invited representatives of the Energy Conservation Council and Stop the Towers to be on the show.  This offer came after Allegheny Power CEO Paul Evanson was a guest last weekend and he mentioned the proposed AP TrAIL.  Many people contacted Mr. Flanagan and he invited us to give our side of the story.   The show was originally planned for Sunday, April 27th, but has been moved to May 4th.  So, as Paul Harvey would say, tune in on Sunday, May 4th at 10:00 am for the "rest of the story!" 

Keep the Letters coming!
Thank you to the many people that have already written letters of support for this effort.  We continue to see Letters to the Editor in several regional newspapers that keeps the public informed and involved.   We ask that you continue to send letters to our elected officials to thank them for their continued support.  Hopefully all our elected officials will continue to work on fighting the NIETC designation and assist Senator Casey's efforts to repeal Section 1221 of the Energy Policy Act.  And finally, we hope you send a thank you letter to those that actively participated in the PUC proceedings on our behalf.  The Office of Consumer Advocate, Office of Trial Staff and the Energy Conservation Council of Pennsylvania did an outstanding job and continue to work through these proceedings.  All groups are currently working on their Briefs which are due on Monday, May 5th and then will submit Reply Briefs by May 29th. 
Together with these groups, we can accomplish our goal to Stop the Towers!

A Successful Day of Action

The April 5th Day of Action was a great success, with at least 225 participants! This is proof that action speaks louder than words. There was great media coverage with key television stations, local newspapers, and radio stations covering the story. 

The event could not have been a success without the individual commitment of the people. Thank you to all of you who donated your time and energy and who remain devoted to stopping the towers. May we together remain strong and persistent in making our feelings known in the future.

There's Still Work to be Done!
Although the technical Evidentiary Hearings are complete, the legal teams from Energy Conservation Council, Office of Consumer Advocate and Office of Trial Staff are putting the finishing touches on the Briefs that must be filed before the PUC.  This is a summary of their stance against the AP TrAIL.  So while they are still at work, it is important that we too remain active.  Here is a list of things each of you can do to keep this fight alive and in the spotlight.  Pick one and do it today!

Say Thank YOU to the Office of Consumer Advocate and Office of Trial Staff.  Unlike in West Virginia where the OCA worked a deal with Allegheny Power to support the proposed line for the promise of jobs and a new building, the PA OCA and OTS have been working diligently to protect all Pennsylvania residents from this unnecessary, greed-driven proposal.  Send them a letter or email and say Thank You!  Encourage them to continue this fight until the end with all the resources at their disposal!!

Contact your elected officials
.  Although it may seem like there is little that our elected officials can do now that the PUC is in its final stages of these proceedings, our elected officials can still make a difference in two major areas.  One, they can help in the fight to repeal Section 1221 of the Energy Policy Act of 2005 that gave the Department of Energy the authority to override a state decision on siting of transmission lines.  This fight is going on now in Washington, DC and we need everyones support.  Two, elected officials have the ability to keep the spotlight on this proceeding and the dealings of Allegheny Power.  We can now see what they have been up to in WV over the past few months, let's not let them attempt the same maneuvers here in PA.

Support the Fundraising Efforts of ECCO.
  Assuming the PUC makes the right decision and denies this application by Allegheny Power, we may still have to go up against the Department of Energy should Allegheny Power go "back-door" and try to use the NIETC designation.  Watch for future fundraiser by ECCO or go to their website and make a direct, tax-deductable donation. 

Sign Senator Casey's Petition.  Go to http://www.casey.senate.gov/actions/ and add your name to the petition showing your support of Senator Casey.  This will take less than two minutes of your time, but will show Congress the support that Senator Casey has in his efforts to repeal the NIETC designations.  Please sign on now!

Evidentiary Hearings May Finish Early
The Evidentiary Hearings in Pittsburgh were scheduled to last until April 12th, but may end as soon as April 2nd!  The Energy Conservation Council, Office of Consumer Advocate and Office of Trial Staff spent many hours cross-examining the TrAIL Co witnesses.  However, TrAIL Co chose to only ask limited questions of the experts that claim the AP TrAIL is an uneccessary, greed-driven proposal!  In fact, when Energy Conservation Council expert George Loehr, whose testimony focuses on the supposed "need" and reliability issues driving the TrAIL project, TrAIL Co didn't ask a single question!  What does this imply?  Could it be that TrAIL Co knew they couldn't defend their position and didn't want the have that pointed out in testimony before the Administrative Law Judges and Commissioners?  Who knows, but it certainly was unexpected!  Loehr has submitted written testimony stating that TrAIL Co has misapplied the National Reliabiliy Standards to create this supposed need that TrAIL Co claims is behind their proposal.   He also states that the TrAIL project is not needed to meet reliability concerns, but rather is potentially driven by economics. 
We also want to thank everyone that was able to attend the hearings.  It was difficult for most people to attend during the work day, but there was always several people there from Washington and Greene Counties.  Thank you to everyone that was able to attend at least one day of the Hearings. 

Help Senator Casey help YOU!
Have you visited the Senators website yet?  Senator Casey has an online petition that opposes the NIETC designation.  The petition states "We need a program to secure clean and reliable energy, not a narrow-minded program that ignores the will of the people. The answer is not the National Interest Electric Transmission Corridors program."  If you agree, please go to Senator Caseys website and sign on today.  Get your entire family to sign, along with your friends, neighbors, and distance relatives in other states.  You don't have to live in Pennsylvania to sign this petition!  The direct link to the petition is

Pennsylvania Senate Needs to Hear from You as well!
Although the House passed two important energy bills, earlier this year, the bills are currently sitting in Senate committees and appear to be going nowhere.  Both of these bills would benefit our cause.  HB 2200 is called the Energy Savings Bill and would require that utilities reduce future demand.  One way to accomplish that would be to provide consumers with "Smart Meters" that would save familes up to 20 % on their electricity bills.  S.S. HB 1, called the Clean Energy Funding Bill, would provide funding for developing alternative energy sources and encouraging the construction of "Green" buildings.  PennFuture, and environmental organization here in Pennsylvania, has done a tremendous job of following these developments and is leading the charge to get the bills passed by the Senate.  You can find additional information on their website at

Evidentiary Hearings are underway!
Thank you to everyone that was able to attend the first day of Hearings!  With over sixty people in attendance showing their opposition by wearing their Stop the Towers t-shirts and carrying signs, the Hearings got underway.  The media was there as all the major television stations and newspapers did stories on how this unecessary, greed-driven line will adversely impact the lives of rural Greene and Washington County residents.  Thank you to all that were involved in organizing and carrying out the first day event.  It is important to continue to show a presence at these hearings, so keep going back!  Carpool or take the "T", but get there as often as you can.  Rebecca Foley is still working with people to help them get to the hearings, so contact her if you need a ride or can offer a ride to others. 

Senator Casey Needs YOUR Help!
As most of us know, the PUC is the first step in this battle.  Once we win at this level, TrAIL Co will almost certainly try to go "back door" on us and ask the federal government to give them what they want and overrule the PUC.  But Senator Casey isn't letting this go on without a fight.  He authored a letter, co-signed by thirteen other Senators, asking the Senate Energy and Natural Resources Committee to hold hearing on the NIETC designations later this year.  He also has begun a nationwide petition in opposition to the NIETC.  Everyone is asked to go to the Senators website and sign this petition!  Senator Casey can only do so much.  We have to show the rest of Congress that the Senator is not alone as he is backed up by thousands of Americans!  Go to his website, www.casey.senate.gov and sign the petition.  Also, take a few minutes and read Senator Caseys Power Lines handout which overviews his concerns and efforts to stop this intrusion into our lives.

Evidentiary Hearing Schedule Correction
It was noted today that a previous Hearing Notice was issued with incorrect starting times for the Evidentiary Hearings beginning on March 24th.  Here is the corrected hearing starting times:

Please go to our PUC webpage and download the corrected document with the starting times.  Post them in your community and pass them out to your neighbors.  Encourage everyone you know to be at the hearings as many days as possible.  Also remind them of the buses that will be provided to help with travel to and from the hearings.  This is a great opportunity to bring the Pittsburgh media and a regional audience into the fight.  Here is the schedule for the buses on the first day.

The Buses are Filling UP!
The PUC Evidentiary Hearings in Pittsburgh are just two weeks away and the buses are filling up!  Beginning at 10:00 am on March 24th at the State Office Building, the Public Utility Commission will begin hearings on the proposed AP TrAIL.  To assist the residents in Washington and Greene Counties, Stop the Towers is organizing buses to take you up and back for the hearings.  For less than the cost of gas and parking, not to mention you won’t have to worry about fighting the traffic, you can ride a bus with other Stop the Towers supporters and be dropped off in front of the State Office Building.  Please contact Rebecca Foley (rfoley1@windstream.net) as soon as possible to reserve your seat.  Departure and return times will be available from Rebecca.
We believe it is important to have residents there.  Apparently, TrAIL Co does not!  Earlier this week, TrAIL Co sent a letter to the Administrative Law Judges asking them to issue an order about proper decorum in the courtroom.  They caution the ALJ’s by asking for “observers in the hearing room is closely monitored for everyone's safety, and to permit sufficient room for all the parties, counsel, witnesses and staff before making space available for observers.”  TrAIL Co is worried that we won’t properly behave and would disrupt the proceedings.  They point to the Public Input Hearings and said that the supporters of TrAIL were “concerned about their personal safety in returning to their vehicles”.  First of all, isn’t it ironic that the same company that had been sending land agents onto our properties, harassing and intimidating people in their own homes, is now worried about that same kind of behavior?  Secondly, never has anyone encouraged nor supported such behavior and we certainly are not now!  We simply believe that it is important to continue to put faces to the rural Americans whose lives will be destroyed or at the very least severely disrupted should this unnecessary, greed-driven proposal be approved!!   So, are you going to stay home as TrAIL Co hopes?  Contact Rebecca and reserve your seat now!!!

DOE Denies Requests for Re-Hearings
Once again, the Department of Energy has ignored everyone, except the utility companies that will profit greatly, by denying all requests for Re-Hearings on the NIETC designations.  Even with a number of environmental groups filing lawsuit against the designations, the DOE continues to support a flawed energy policy that will encourage long-distant transmission lines coming from the highly polluting, coal-fired generation plants rather than cleaner, safer alternatives.  Better alternatives which include demand-side management programs, conservation, upgrading existing infrastructure and the most reasonable solution, building the generation plants near the demand.  Utility companies benefit greatly from section 1221 of the Energy Policy Act of 2005 as they will be granted profits of up to 14% or more, passing ALL costs on to the rate payers and all the while taking property and destroying the lives of rural Americans.  This is exactly what is happening here in southwestern Pennsylvania with the proposed AP TrAIL!  Fortunately, most environmental groups and at least some of our Congressman see the flaws in this policy.  We must be thankful for people like Senator Casey and the others that recently requested Senate hearings on section 1221.  You can read more about Senator Casey’s efforts below on this webpage. 
Please continue to encourage Senator Casey and others to push for the complete repeal of Section 1221 of the Energy Policy Act of 2005.  Specifically here in Pennsylvania, please contact Senator Specter (contact info below) and encourage him to support a complete repeal of the above Act.  Senator Specter did sign Senator Casey’s letter asking for the hearings and he is listening.  But we must contact him and tell him our concerns because you can be sure the utility industry lobbyists are talking with him every chance they get.  If he is not hearing from us, how is he to know what we are going experiencing?  Please email the Senator now.  We need him on our side!

Next Step in the PUC Proceedings
The Public Utility Commission process moved one step closer to the Technical Evidentiary Hearings by accepting the Surrebuttal Testimonies relating to the proposed AP TrAIL.  The witnesses from the Energy Conservation Council of Pennsylvania, the Office of Consumer Advocate and the Office of Trial Staff gave excellent testimony that refutes that allegations of TrAIL Co's "need" for this transmission line.  These witnesses address not only the supposed reliability issues raised by TrAIL Co, but also attack the manner and methods used to put together the proposal before the PUC.  Their testimonies can be found on the PUC Testimonies page of this website.  Although much of it is very technical, you can certainly get the idea behind the testimony that supports our contention that these lines are not needed, do not benefit the local communities of Greene and Washington Counties and that the real motive is to make money!  Take some time and read through these testimonies and then get involved!! 

"Road Trip" to Pittsburgh
How can you get involved you ask, let us count the ways!  Here's the first and probably most important way right now, attend the upcoming PUC Evidentiary Hearings!  The hearings will begin on March 24th and run through April 11th, 2008 at the State Office Building in Pittsburgh.  We are gearing up now to have a show of opposition at the hearings by getting as many supporters of Stop the Towers to attend each day of the hearings.  In an effort to help get you there, we are organizing buses to take you there and return you to Washington and Greene Counties.  All you have to do is show up at the designated pick-up areas and we'll do the rest.  We hope to provide the buses for as little cost as possible, if not free.  Please email Rebecca Foley at

Other Groups Agree with US!
Over the past year, more and more groups from across Pennsylvania and the nation have begun to take notice of our issue and similar issues across the country.  Many have begun to weigh in on this new effort to construction high voltage lines across the rural landscapes and the potential damage they will bring.  Some have gotten directly involved in the proposed AP TrAIL by either offering testimony at the Public Input Hearings or by giving other forms of support.  We have mentioned many of them on this website in the past and will continue to link to those groups.  Please go to our Related Links page to see who these groups are and what they are doing to make our country a better place!

Senator Casey Requests Hearings on NIETC Designation
Pennsylvania Senator Robert Casey led an effort to request the Senate Energy and Natural Resource Committee to hold hearings on the recently designated NIET Corridors in the Mid-Atlantic and Southwest regions of the country.  The letter asks Senators Jeff Bingamon, Chair, and Pete Domenici, Ranking member, to hold hearings to "bring all pertinent information to bear on the determination of the broad implications of the NIETC."  Thirteen other Senators co-signed the legislation , including Pennsylvania Senator Arlen Specter and others from States included in the Mid-Atlantic NIET Corridor designation by the Department of Energy.  Go to the NIETC web page on this site to read the entire letter.  Great job Senator Casey!!!

Energy Independence Legislation Moves Forward
This past week, the House voted to approve one of the Energy Independence Strategy bills and sent it to the Senate for their consideration.   House Bill 2200 requires the Public Utility Commission to establish energy conservation programs in the service territories of all electric distribution companies. It also provides every electricity customer in the Commonwealth with a smart meter, the tool necessary for businesses and families to manage their energy use. It is estimated that this program could help families save up to 20% on future utility bills.  This is important especially considering that Rate Caps are set to expire in the next several years.  It also reduces demand and thus the pollution created by the generation plants that must meet that demand.  Please call your state Senator and encourage them to vote for this legislation.

PUC Rules on TrAIL Co Objections to Public Input Hearing Testimonies and Exhibits
The PUC has ruled on the objections raised by TrAIL Co to the exhibits offered during the Public Input Hearings that occurred in August and September of last year.  The results are mixed, with many items ruled admissible while others were thrown out.  Read the entire ruling by clicking HERE or on the document image below.

FAA Responds to Complaints of "Low-flying Helicopter"
The FAA investigated the complaints of a low-flying helicopter that was following the proposed route of the AP TrAIL.  It was found to be a sub-contractor, Air Flights Inc out of Oklahoma, hired by TrAIL Co to perform aerial surveying.    The pilot was granted permission to fly as low as 500 feet to complete the surveying.   It would appear that this is TrAIL Co's way of getting around their own "Code of Conduct" where they agreed to stay off of landowners properties without their express written consent.

The State-level Fight Against TrAILCo The Technical Evidentiary Hearings (where our lawyer will work to prove this line is unnecessary) have been postponed until the spring. This is very good news.
This delay gives our attorney and witnesses until March to prepare and reply to the multitude of witnesses that TrAILCo has had to produce in response to the excellent testimony given at the Public Input Hearings. Great job one and all!
The hearings will now be held at the Pittsburgh State Office Building on March 24 at 9 a.m.; March 25-28 at 10 a.m.; March 31 at 9 a.m.; April 1-4 at 10 a.m.; April 7 at 9 a.m.; and April 8-11 at 10 a.m. Please try to attend as many of the hearings as you can. The Civil Fight Against the Rights-of-Way
Judge Richard DiSalle continues his work on the rights-of-way lawsuit on behalf of his clients in Washington County. On December 21, 2007, Judge Debbie O’Dell Seneca met with both sides and allowed the case to move forward. Judge DiSalle also hopes to begin the Greene County process very soon. The National Fight Against the NIETC

Momentum against the TrAILCo application is growing, as well as opposition to the NIETC (National Interest Electric Transmission Corridor) designation made by the U.S. Department of Energy. 
  Senator Casey visited one of our sites last fall and has kept his promise to fight this issue. His opposition has been instrumental in helping us to attract broader attention for this issue, as it stands to impact energy policy for our entire nation.
Additionally, the PUC, along with many of our elected officials and state agencies, have voiced a strong NO to the NIETC designation. They have demanded a rehearing on the corridor designation, and the PUC has gone so far as to file suit in U.S. District Court against the Department of Energy.

State agencies, utility commissions, governors and attorneys general from Arizona, California, Pennsylvania, Delaware, Virginia, Maryland, New Jersey and New York have filed rehearing requests as well, and the Department of Energy has agreed.
Eleven regional and national environmental organizations announced plans to file suit against the Department of Energy over the NIETC designation. Led by the National Wildlife Federation and the Piedmont Environmental Council, the groups are challenging the designation on grounds that the Department of Energy violated the National Environmental Protection Act and Endangered Species Act by failing to study the potential harmful impacts of the corridor on air quality, wildlife, habitat and other natural resources.

What Else You Can Do To Help
Stay informed. We will be holding our next Community Rally/Dessert Reception on Wednesday, February 20, 2008, at 7 p.m. at the Lone Pine Social Hall. Bring a favorite dessert to share and catch up on the latest developments.

Be vigilant. Remember,TrAILCo is not a public utility. They do not own the rights-of-way. You should not allow them on your property.You should document any intrusions onto your property. TrAILCo has told the PUC that they are adhering to a standard of conduct by which they will not enter a property unless they have the expressed permission of the landowner. We have every reason to believe that they are not doing this. If you know of trespass violations, please keep accurate records and let us know, so we can pass the information on to the PUC. You can also report these violations on the Hotline, (724) 267-3040.

Help us spread the word. Share this information with friends and neighbors. As we have proven in the past, together we are very strong.

Write your local elected officials, newspaper editorial page, state senator and representatives and express your opinion. They are listening. Contact information can be found at www.stopthetowers.org. This is also your best source for accurate information.  We need to make a concentrated effort to get Senator Specter involved in the NIETC battle!  PLEASE CALL, EMAIL AND SEND LETTERS TO SENATOR SPECTER AND ASK FOR HIS SUPPORT OF SENATOR CASEY'S EFFORTS TO REPEAL SECTION 1221 of the Energy Policy Act of 2005!

Indiana Bat Survey

The Indiana Bat is an endangered species that TrAILCo has to prove can not be found in the vicinity of the towers. TrAILCo has to conduct tests to prove there are no Indiana Bats in our area. In order to conduct these tests, they must erect large nets to catch bats. Remember, TrAILCo is not a public utility. They must have your express permission to erect this apparatus on your property!!! They do not own the Rights of Way; therefore, it is your right to deny them access.
We ask that you do two things.  First, download the Indiana Bat Survey, complete and return to the address included on the survey.  Seond, please call the new HOTLINE 724-267-3040 to let us know if you have been
approached to allow these tests or if they have come on your property without your permission!!  Leave a message and a representative from Stop the Towers will get back to you. Again, thank you for your support and vigilance!!

PUC Agrees to Change Schedule
This is a big deal! The Adminstrative Law Judges have agreed to slow down the PUC process!!  A motion was filed on behalf of the Energy Conservation Council to allow for much needed time to digest the volumes of information from the Public Input Hearings, expert written testimony and the rebuttals.  Although the PUC is aware of the one year time limit imposed by the NIETC designation and TrAIL Co's insistance to push forward as quickly as possible, the ALJ's made the right decision and altered the schedule.  Those of you planning to attend the Evidentiary Hearings in January will need to look at your spring calendar in March and April.   Here is the new schedule:

1.         The hearings scheduled for January 23-25 and 28 -30, 2008, will be cancelled.

2.         Intervenors’ written surrebuttal due in hand to ALJs and Full Service parties on  February 13, 2008

3.         TrAILCo’s written rejoinder due in hand to ALJs and Full Service parties on March 19, 2008.

4.         Technical evidentiary hearings in Pittsburgh commencing at 10:00 am on March 24, 2008, with subsequent hearing commencing at 8:30 am on March 25, 2008, thru March 28, 2008, March 31 through and including April 4, 2008, and April 7, 2008, through and including April 11, 2008.

TrAIL Co Objects to Testimonies/Exhibits from Public Input Hearings

TrAIL Co filed an objection with the PUC asking that testimonies or exhibits offered by 37 different people during the Public Input Hearings be thrown out.  Most of the objections claim that the presenter did not follow proper procedure or that the evidence offered should be considered "hearsay".  This was the only opportunity for most citizens to have any input or say in the proceedings without hiring a legal expert to represent them before the PUC.  Hopefully, the Adminstative Law Judges will rule in favor of the landowners and other concerned citizens that are trying to protect their families, homes and properties.

TrAIL Co Files Objections to Judge DiSalle Suit
TrAIL Co has responded to the multi-plaintiff lawsuit filed by Judge DiSalle on behalf of many Washington County landowners challenging the legality of the right-of-ways claimed by TrAIL Co.   A hearing on the objections will be held on December 20th before Judge Debbie O'Dell Seneca where she will either rule to dismiss the suit, require modifications to the suit, or dismiss the objections filed by TrAIL Co which would permit the lawsuit to move forward.  Judge Disalle is also considering filing a similar suit in Greene County court.  If you or someone you know would like to be a part of this effort, contact Susan Foster Blank at

DOE Agrees to "Re-Hearing"
The Department of Energy has agreed to hold "Re-Hearings" on the two NIETC designations.  Many groups and individuals filed for the re-hearings and finally, the DOE listened!  Although we do not yet know how this process will occur, it is certainly a victory for our cause and for everyone that wants to see a comprehensive energy policy that incorporates conservation, efficiency standards and localized generation.  Chalk one up for the grassroots efforts!

TrAILCo Responds to OCA Motion
As mentioned below, the Office of Consumer Advocate filed two motions with the PUC relating to the inappropriate behavior of the land agents working for TrAILCo.  In their response, TrAILCo has agreed to a specific code of conduct for its land agents and to hire a new firm in the next two to three months.  TrAILCo also argues that they are not a "public utility" and does not have to follow the codes set forth for utility companies.  Hopefully, the ALJ's will soon rule on the motions. 

Energy Independance Strategy is Crucial to our Cause
Earlier this year, Governor Ed Rendell proposed his Energy Independance Strategy (EIS) which would require utility companies to stop "growing" electricity demand by mandating conservation and higher efficiency standards and to use alternative methods before constructing high-voltage transmission lines.  It also would require Smart Meters to be installed in homes so that customers can reduce consumption during peak demand.  Each of these would have been beneficial to our cause if they had been in place a year ago.  We need to help the various groups around the state, including PennFuture, to encourage our elected officials to act on the bills relating to EIS. 
Please call, email or write not only your state representative and senator, but also Majority Whip Keith McCall and tell them to get the job done before the holiday break.  PennFuture has information available on their website at http://www.pennfuture.org/actionalerts_detail.aspx?ActionID=41&Home=Y. They also have given us some background information and a sample letter from which to construct your letter/email.  Special thanks to Heather Sage for her help with this document. 

OCA Files Motions in Response to YOUR Testimonies 
The Office of Consumer Advocates has filed two motions this week before the PUC, both as a result of the incredible testimony that was given during the Public Input Hearings.  The first motion is to require AP/TrailCo to "
Cure Due Process and Regulatory Violations."  This motion is a result of numerous testimonies by landowners that were not properly notified by AP. Those residents would include "affected landowners" that either recieved no notice or insufficient notice of the specific location of the proposed line.   Also included in this motion are those residents living near a proposed change of the line from it's original route.  The motion requests that the PUC force TrAILCo to properly notify all affected landowners of the specific location of the proposed route and give an opportunity for additional public comments by those mentioned in the motion.
The second motion filed by the OCA is for "
Injunctive Relief", which  requests that TrAILCo and its land agents, acting on behalf of Allegheny Power, be enjoined from engaging in activities including misrepresentation of facts, coercive acts, or harassment of consumers.  In other words, it asks that representatives of TrAILCo stop harassing landowners to sign the Property Damage Agreements as well as to void any that were signed under the above mentioned circumstances.  These motions would not have been filed were it not for the courage of those that testified in August and September.  Thank you to everyone that testified or were in attendance to  support those that testified.

Our Work is Not Done
We need you to write letters of support for the motions filed by the OCA.  Although many of you already gave testimony, there have been additional reports of similar behavior by TrAILCo representatives since the hearings of which the OCA is unaware.  The
Greene County Commissioners have already submitted their support for the motions.  Use it as a guide, or better yet, just tell your story.  Give them the facts as you did during the Public Input Hearings.  Once you write your letter, send it via email to the Greene County Department of Economic Development (see below for email address).  Robbie Matesic will make certain that everyone on the service list recieves a copy of your letter as is required by the PUC.   These letters must be recieved in the Greene County office no later than November 7th in order to reach the entire service list before AP responds to the motions.

Thank You, Thank You, Thank You!
We are finishing up our first major fundraising event, the Cash Bonanza Raffle ticket, and we owe many of you a big THANK YOU!  Although we didn't sell all the tickets, we did sell enough to raise some money to help offset the costs of our battle before the PUC.  Specifically, the money will help cover the costs of expert witnesses that have now provided written testimony on our behalf (see below).   So thanks to all of you that bought or sold tickets.  Your determination in the last two weeks before the drawings began showed the same resolve as the testimonies during the public input hearings.  Speaking of which, be sure to see below the motions filed by the OCA in response to your testimonies!

Expert Testimonies Submitted
The Energy Conservation Council of PA (ECCO), which is representing approximately 1,500 residents of SW PA before the Public Utility Commission, has submitted it's written expert testimony.  The experts that provided the testimony were Dr. Robert Hanham, an Associate Professor of Geography at WVU, Dr. Rick Hoch, a Certified Planning expert, and Mr. George Loehr, a 45 year veteran in the area of transmission planning and bulk power system realiability. 
Dr. Hanham's testimony focuses on the Uneven Economic Development potential that could arise should the AP TrAIL be constructed.  Dr. Hoch's testimony focuses on the potential environmental impact and the siting procedure that was used by AP to choose the preferred route for the TrAIL.  Mr. Loehr presented testimony that focuses on the "need" for the two parts of the AP TrAIL.  ECCO has also been involved in other procedural events before the PUC including several "discovery" disputes, filing 3-4 motions and fighting with AP to produce the documents that are needed.

LAWSUIT FILED
Last week in Washington County, Judge Richard DiSalle filed a multi-plaintiff lawsuit that challenges the legality of the rights-of-way that Allegheny Power claims to already own along the proposed AP TrAIL.  Additional concerns about the line include marred landscapes, potential damages to crops, destroyed farmlands, decreasing property values, contaminated drinking water, negative health impacts from electromagnetic fields and herbicides, environmental issues and energy rate increases, among many others.  Judge DiSalle expects to also file a similar lawsuit on behalf of Greene County landowners in the near future.  If you are interested in joining the lawsuit, please contact Susan Foster Blank at sfblank@bentcom.net.

THEY DID WHAT?!?
Another major development was the Department of Energy designating the Mid-Atlantic National Interest Electric Transmission Corridor (NIETC) earlier this month.  Many people, including our PA state and federal legislators, were outraged at the DOE's arrogance and defiance to the public comments on this proposal.  Almost all of the 2,000 + testimonies on the proposed corridors were very much against such a designation for many, many reasons, and yet they fell on deaf ears.  Read the response to these designations by Governor Ed Rendell,  Senator J. Barry Stout and Representative Bill DeWeese.   Also read the joint response by Senator's Robert Casey, Jr and Arlen Specter. 

SPEAK UP
If you feel as these elected officials do, then speak up!  Write, email and call your state and federal elected officials and the DOE to express your outrage at such arrogance.  In fact, contact President Bush and Vice-President Cheney as well and let them know how you feel!  If you submitted written testimony earlier this year to the DOE on the then "Draft Corridors", you can also file for a "Re-Hearing".  This is an important part of the proceeding to show that the citizens do not agree with this designation and that we want it changed.   The Application for Re-Hearing must be recieved by the DOE by 5:00 pm, November 5, 2007.  The DOE chose not to offer the convenience of the electronic filing of the application, so the application must either be faxed (best choice), mailed (not likely to make it in time) or hand-delivered.  Go to the website http://nietc.anl.gov/rehearing/index.cfm for additional information and requirements.

Four coal-fired power plants in Western Pennsylvania have landed on this year's ranking of the 50 dirtiest power plants for the greenhouse gas carbon dioxide,
according to a new report by the Environmental Integrity Project.





BACKGROUND


Allegheny Power plans to run a massive 240 mile 500 kilovolt power line through our communities in Washington and Greene Counties in Pennsylvania, across northern West Virginia and into northern Virginia. The transmission towers could be up to 160 feet tall and the rights of way could be 200 feet wide. The lines will be engineered to be capable of carrying twice the power of a normal 500kv line.

The proposed route options have changed at least once.  Go to Allegheny Power's website (APTrAILinfo.com) to view maps of the current route. We also have some maps posted on this website. For more information, including a complete timeline of the project filings, the Piedmont Environmental Council in Virginia has a good website.

The line is part of a five-year regional electric transmission plan approved by PJM Interconnection, which manages electric transmission services of the Mid-Atlantic power grid in 13 states and Washington DC. Allegheny Power's transmission zone is in PJM's region. Dominion Virginia Power will construct the line within its transmission zone. The line in Allegheny Power's zone will be about 210 miles long and the entire line will be 240 miles long.

We believe that the main purpose of this power line is to move cheap electricity from western Pennsylvania and West Virginia to the mid-Atlantic in order to increase Allegheny Power's profits. Allegheny Power estimates that the project will cost $1.3 BILLION. Allegheny Power's portion is currently estimated at $820 million. Note that the Department of Energy has not identified western Pennsylvania as a transmission bottleneck or a critical congestion area.

We believe this transmission line will NOT economically benefit citizens or businesses of western Pennsylvania. In fact, a portion of the capital costs of constructing the transmission line will be paid for by Allegheny Power's rate-payers . Allegheny Energy already received an "incentive" rate increase from the Federal Energy Regulatory Commission (FERC), and at least part of this increase will be used to fund this project.  According to Allegheny Power's expert testimony, the incentive rate increase was needed to entice private investors to the project, because of inherent business risks associated with the project.  In part, this rate increase guarantees investors a certain return on their equity.  We are trying to establish how much the rate increase will be and how it will affect us (see the TrailCo (an indirect subsidiary of Allegheny Energy) filing to FERC here and the news release here). If Allegheny Power is your electricity provider, the cost of your electricity will increase, whether or not the transmission line comes near your property.

The transmission line will diminish our quality of life, decrease our property values, possibly endanger our health, increase our electric rates, increase local and regional air pollution, and we believe it IS NOT NECESSARY to meet energy demands in the mid-Atlantic or to make the nation more secure. This is not just a Not In My Backyard (NIMBY) issue. We believe this power line is not the best choice for our nation's energy policy.  View an objective expert's opinion.

As discussed below, Allegheny Power has applied for early designation of National Interest Energy Transmission Corridor (NIET) from the federal Department of Energy. Under the Energy Policy Act of 2005 (EPAct 2005), if the AP TrAIL is granted NIET status, then state PUCs have only one year to approve these projects. If PUC approval is witheld for more than a year from the date of the state application, or a year from the date of NIET designation (the clock starts ticking at the later date), the FERC can act as permitting authority. See Section 1221 of EPAct 2005 for more information. Allegheny Energy has referred to this as "backstop" authority in their presentation.

We, the residents, businesses, and friends of Allegheny, Washington and Greene Counties, call on our elected officials to prevent this transmission line proposal from moving forward.

Is this massive transmission line the correct solution?

There should be more public discussion on the actual energy demand and how to meet it. We believe there are more efficient, secure, and cost-competitive solutions. Energy conservation should be the first choice. In addition, power should be generated closer to the users of that energy. To increase reliability and security, users should be required to conserve as much energy as possible, generate renewable energy locally, or as a last resort, have cleaner and more efficient power plants built closer to the demand.

What is NIET and why should that concern me?

The National Interest Electric Transmission (NIET) Corridor designation was established by the Energy Policy Act of 2005. The intent of NIET was to ensure that electric transmission lines were sited quickly when transmission was determined to be the CORRECT solution to SEVERE congestion or reliability problems.

In March 2006, PJM Interconnection and Allegheny Power requested early National Interest Electric Transmission (NIET) Corridor designation for the AP TrAIL project from the Secretary of the U.S. Department of Energy (DOE). View the extent of the corridors here.  The corridors cover the entire states of MD and DE and large portions of PA, WV and VA. 

On April 26, 2007, the U.S. Department of Energy (DOE) Secretary Samuel W. Bodman announced the issuance of two draft National Interest Electric Transmission Corridor (National Corridor) designations. The Energy Policy Act of 2005 authorizes the Secretary, based on the findings of DOE's National Electric Transmission Congestion Study (Congestion Study), to designate National Corridors.  View a map of the proposed Mid Atlantic Corridor.  It covers almost 3/4 of the state of Pennsylvania.  See the DOE website for more information and how to comment on these corridors. 

By seeking NIET designation, Allegheny Power and their partners are trying to limit the state Public Utility Commission (PUC) reviews, a process that is supposed to protect the public, to one year.
NIET designation would also allow Allegheny Power to take rights of way under federal eminent domain. We ask all citizens, and local, state and federal officials, to write to the Department of Energy and reject this proposal for the following reasons:

1) There has not been an adequate consideration of specific alternatives to new transmission lines, including a full range of demand management and peak demand reduction measures, energy conservation measures, renewable sources, new generation capacity of energy located nearer the East Coast, and alternative transmission technologies and upgrades;

2) There has not been an assessment of impacts on human health and the environment, a requirement by the National Environmental Policy Act which is reasonable given the demonstrated potential impacts on historic, scenic, natural, and cultural resources in the proposed corridor;

3) Allegheny should be required to provide the public with the data and assumptions to enable independent verification of the claimed potential for power disruptions;

4) In Allegheny Power's proposal to DOE, they admit they do not meet all of the criteria for NIET designation. They also state that these criteria should not be applied rigidly by DOE, even though the criteria are meant to determine whether projects are worthy of NIET designation;

5) Many citizens across the 240 mile project area have already commented to DOE that they oppose early designation of NIET for the AP TrAIL project. These comments can be viewed at the Department of Energy website; and

6) At least one member of Congress has officially opposed the early NIET designation. Rep. Frank Wolf (R-10th-VA) wrote to the DOE to oppose the AP proposal. Click the Wolf Letter button to read the text of this letter.
